Once reservation has been made, guests are required to complete our rental agreement and guest verification agreeing to the following: 1. OCCUPANCY & USE • Maximum occupancy: 21 guests (unless approved in writing) • Registered guests only • No parties, events, or gatherings Violation may result in: • IMMEDIATE TERMINATION WITHOUT REFUND • Removal from the Property • Additional fees 2. QUIET HOURS & CONDUCT • Quiet Hours: 10:00 PM – 7:00 AM • Excessive noise or disruptive behavior prohibited Violations or verified complaints may result in: • A minimum $500 noise violation fee • Loss of amenity access • Immediate termination without refund 3. EXTERIOR SECURITY CAMERAS • Exterior cameras only (no interior cameras) • Located at entry points and exterior areas • Used solely for security and safety • Guest consents to exterior monitoring 4. NO SMOKING • Smoking or vaping of any kind is strictly prohibited inside the Property • Smoking outdoors only, with proper disposal Violation will result in a minimum $500 smoking remediation fee, plus any additional costs required for ozone treatment, deep cleaning, deodorization, or damage repair. 5. PET POLICY • $115 pet fee • Maximum 2 dogs • No pets on furniture • Guest responsible for pet damage and cleaning 6. CHECK-IN / CHECK-OUT Optional add-ons (subject to availability): • Early Check-In: $75 • Late Check-Out: $75 • Luggage Drop-Off: $50 Unauthorized late checkout: $50 per 30 minutes ⚠ WATER FEATURES — ASSUMPTION OF RISK & LIABILITY WAIVER (POOL · HOT TUB · LAKE · DOCK · KAYAKS · PADDLEBOARDS) THIS SECTION AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY. 7. ASSUMPTION OF RISK The Property includes inherently dangerous water features including: • Indoor swimming pool • Hot tub • Lake access and shoreline • Dock • Kayaks and paddleboards Guest VOLUNTARILY AND EXPRESSLY ASSUMES ALL RISKS, known or unknown, including: • Drowning • Slipping or falling (wet surfaces may be slippery at any time) • Head, neck, or spinal injury • Overheating, dehydration, heat illness • Equipment misuse or failure • SERIOUS INJURY OR DEATH No lifeguard is on duty. Swim at your own risk. 8. FULL RELEASE OF LIABILITY (INCLUDING NEGLIGENCE) TO THE FULLEST EXTENT PERMITTED UNDER INDIANA LAW, GUEST RELEASES, WAIVES, AND FOREVER DISCHARGES: Host, the Property Owner, and all managers, agents, employees, and contractors FROM ANY AND ALL CLAIMS, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE, relating to: • Use of any water feature • Use of dock, shoreline, or watercraft • Failure to supervise minors • Injury, illness, disability, or death THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE PROHIBITED BY LAW. SEPARATE ACKNOWLEDGMENT — WATER FEATURE WAIVER Guest acknowledges that Sections 7–9 contain a RELEASE OF LIABILITY AND ASSUMPTION OF RISK relating to pools, hot tubs, lake access, docks, and watercraft. Guest agrees this waiver is a material condition of occupancy. % 9. INDEMNIFICATION Guest agrees to DEFEND, INDEMNIFY, AND HOLD HARMLESS Host and the Property Owner from any claims (including attorney fees) brought by: • Guest • Any member of Guest’s party • Any minor or visitor arising from use of the Property or water features. 10. WATER SAFETY RULES • NO DIVING in pool, hot tub, or lake • No running on pool deck • No glass near water • No use of water features while under the influence of alcohol, drugs, or impairing substances • Children must be supervised at all times • Life jackets are provided but do not replace supervision • Only electric motors permitted on lake • Dock and shoreline conditions vary due to weather and water levels • Host provides no instruction on kayak/paddleboard use $500 fee if hot tub must be drained/refilled due to misuse. 11. MINORS — PARENT/GUARDIAN CONSENT Signing Guest represents they are the parent or legal guardian of all minors in the party, or have authority to consent on their behalf. Guest accepts full responsibility for supervision and agrees all waivers apply to minors to the fullest extent permitted by Indiana law. 12. MEDICAL FITNESS & EMERGENCY CONSENT Guest represents all persons using water features are medically fit to do so and have no condition increasing risk. Guest authorizes Host to obtain emergency medical treatment if necessary and agrees to be financially responsible for such treatment. 13. AMENITY OUTAGE DISCLAIMER Pool, hot tub, watercraft, and similar amenities are provided as a courtesy and are not guaranteed. Temporary outages, maintenance closures, weather conditions, lake conditions, mechanical issues, or force majeure events do not constitute grounds for refund. 14. INSURANCE DISCLAIMER Host does not provide insurance coverage for Guest or Guest property. Guests are encouraged to maintain travel and liability insurance. 15. DAMAGES & PAYMENT AUTHORIZATION Guest authorizes Host to charge the payment method on file for damages, rule violations, excessive cleaning, or fees under this Agreement. 16. PLATFORM TERMS If booking occurs through Airbnb, VRBO, or another platform, this Agreement supplements platform terms and controls where not prohibited by platform policy. 17. TERMINATION Host may terminate occupancy immediately for safety violations, rule violations, or risk-creating behavior. No refunds will be issued. 18. GOVERNING LAW, VENUE & ATTORNEY FEES This Agreement is governed by Indiana law. Venue for any dispute shall be exclusively in Vigo County, Indiana. Prevailing party is entitled to reasonable attorney fees and costs. 19. SEVERABILITY If any provision is held unenforceable, the remainder remains in full force and effect. 20. ACKNOWLEDGMENT By booking or occupying the Property, Guest confirms they have read and understand this Agreement and accept all terms.
